You can file a divorce application if you have been separated from your former spouse for at least a year. You could be living under the same roof and yet be separated. However, during this period, you and your former spouse should be able to prove that you were leading separate lives.

If it’s a consensual divorce, you could jointly apply for a divorce. If your former partner doesn’t agree, you could still apply for divorce, so long as a divorce application has been served on your former partner before the divorce hearing.
